California SB 440 / Civil Code § 8850 — Effective January 1, 2026
Late payment on a construction project? Collect 2% monthly interest.
Interest Enforcer generates SB 440 demand letters, mails them Certified Mail + Return Receipt, and tracks every statutory deadline so you know exactly when interest starts accruing.
How it works
1. Create a claim
Enter the project, parties, amount owed, and upload your invoice or change order as evidence.
2. Generate or mail
Generate a PDF demand packet ($49) to mail yourself, or we print and send Certified Mail + Return Receipt ($129).
3. Track deadlines
Deadlines start on delivery date. We track the 30-day response window, 60-day payment window, and interest accrual.
What SB 440 means for contractors and subs
2% monthly interest on late payments
If the property owner does not pay the undisputed amount within the statutory window, interest accrues at 2% per month on the unpaid balance.
30-day response deadline
After delivery, the owner has 30 days to respond with a written statement. No response means the claim is deemed denied.
60-day payment deadline
Once the owner responds, they have 60 days to pay the undisputed portion. After that, interest starts.
Meet-and-confer + stop-work rights
Track meet-and-confer scheduling, mediator selection, and stop-work notice dates — all built into the workflow.
